Free Audits:
- Marketing strategy audits, brand messaging audits, AI roadmaps, and similar deliverables
- Delivered within 5 business days (subject to scheduling)
- Provided at no cost with no obligation to purchase
- We reserve the right to limit free audits to serious business inquiries
4. Paid Services
Acceptance of Proposals:
- Paid services require written agreement (email or signed proposal)
- Pricing and scope will be outlined in service agreements
- Payment terms will be specified in individual agreements
Service Delivery:
- We will use reasonable efforts to meet agreed-upon timelines
- Timelines may be adjusted based on client responsiveness and scope changes
5. Refund Policy

- 30-day money-back guarantee
- Full refund if you're not satisfied, no questions asked
Monthly Services ($3,000/month):
- 30-day money-back guarantee (first month only)
- No long-term contracts required
- Cancel anytime with 30 days' notice
6. Intellectual Property
Your Content:
- You retain ownership of all materials you provide to us
- You grant us license to use your materials solely to provide Services
Our Work Product:
- Upon full payment, you own deliverables created specifically for you (audits, strategies, content)
- We retain ownership of our methodologies, templates, and processes
- We may use your project as a case study (with your written permission)
Our Website:
- All content on our Website (text, graphics, logos) is owned by One Button Agency or our licensors
- You may not reproduce or distribute our Website content without permission
7. Client Responsibilities
You agree to:
- Provide accurate information
- Respond to requests for information in a timely manner
- Grant necessary access to accounts/platforms for implementation
- Review and approve deliverables within agreed timeframes
8. Confidentiality
Our Commitment:
- We will keep your business information confidential
- We will not share your proprietary information without permission
Your Commitment:
- Our strategies, methodologies, and recommendations are confidential
- Do not share our proprietary processes without permission
9. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for Services in the past 6 months
- We do not guarantee specific business results (revenue, traffic, conversions)
10. Results Disclaimer
No Guarantees:
- We provide strategic recommendations based on our expertise
- We do not guarantee specific business outcomes or revenue results
- Results depend on many factors outside our control (market conditions, execution, etc.)
- Case studies represent past results and do not guarantee future performance
11. Termination
Either party may terminate:
- Free consultations can be canceled anytime
- Paid services can be terminated with 30 days' written notice
- Upon termination, you pay for work completed to date
We may terminate immediately if:
- You breach these Terms
- You provide false or misleading information
- You engage in abusive or illegal conduct
12. Third-Party Services
We may use third-party tools (Make, n8n, OpenAI, Claude, etc.) to deliver Services. We are not responsible for third-party service failures or changes.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our Website with a new effective date. Continued use after changes constitutes acceptance.
14. Relationship
These Terms create a service provider relationship, not a partnership, employment, or agency relationship.
15. Governing Law
These Terms are governed by the laws of the State of New York.
Disputes will be resolved through:
- Good faith negotiation first
- Binding arbitration if negotiation fails
- Courts of Albany County, New York as a last resort
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
17. Entire Agreement
These Terms, along with our Privacy Policy and any signed service agreements, constitute the entire agreement between you and One Button Agency.
